Welcome to SudurBite ("SudurBite," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of the SudurBite website, mobile application, and all related services available at https://sudurbite.com.

By accessing or using SudurBite, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. About SudurBite

SudurBite is an online food ordering and delivery platform serving customers across Far Western Nepal. We connect customers with restaurants and delivery partners, allowing users to browse menus, place orders, and receive food deliveries.

2. Eligibility

To use SudurBite, you must:

  • Be at least 18 years of age or have permission from a parent or legal guardian.

  • Provide accurate and complete account information.

  • Maintain the confidentiality of your account credentials.

  • Be responsible for all activities conducted through your account.

3. User Accounts

When creating an account, you agree to:

  • Provide true, accurate, and current information.

  • Keep your login credentials secure.

  • Update your information when necessary.

  • Notify us immediately if you believe your account has been accessed without authorization.

SudurBite reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Ordering Food

By placing an order, you agree that:

  • All order information is accurate.

  • Delivery address and contact details are correct.

  • You are available to receive the order.

  • Restaurants are responsible for preparing the food.

  • Estimated delivery times are approximate and may vary due to traffic, weather, restaurant preparation time, or other unforeseen circumstances.

Once an order has been confirmed by the restaurant, it may not be possible to modify or cancel it.

5. Pricing

Prices displayed on SudurBite are determined by the participating restaurants.

The total amount payable may include:

  • Food price

  • Delivery fee

  • Service fee (if applicable)

  • Government taxes (where applicable)

Prices and promotions may change without prior notice.

6. Payments

SudurBite may support payment methods including:

  • Cash on Delivery (COD)

  • Other payment methods available in Nepal

Payments processed through third-party payment providers are subject to their own terms and conditions.

7. Cancellations

Orders may only be cancelled before restaurant preparation begins.

Once the restaurant has accepted and started preparing your order, cancellation requests may be declined.

SudurBite reserves the right to cancel any order due to:

  • Restaurant closure

  • Item unavailability

  • Delivery issues

  • Payment verification issues

  • Suspected fraudulent activity

  • Technical problems

If payment has already been made for a cancelled order, any applicable refund will be processed according to our Refund Policy.

8. Refunds

Refunds may be issued in situations such as:

  • Payment failure

  • Restaurant unable to fulfill the order

  • Duplicate payment

  • Cancelled orders eligible under our policies

Refund processing times depend on the payment provider or financial institution.

SudurBite reserves the right to investigate refund requests before approval.

9. Delivery

Delivery times shown in the app or website are estimates only.

Delays may occur due to:

  • Traffic conditions

  • Weather

  • Road closures

  • Restaurant preparation delays

  • High order volume

  • Other circumstances beyond our control

Customers should ensure someone is available at the delivery location to receive the order.

If the customer cannot be contacted after reasonable delivery attempts, the order may be marked as completed and no refund may be provided.

10. Restaurant Responsibility

Restaurants are solely responsible for:

  • Food preparation

  • Food quality

  • Hygiene and safety

  • Ingredient information

  • Portion sizes

  • Allergens

  • Packaging before handover

SudurBite acts as a technology platform connecting customers, restaurants, and delivery partners and is not responsible for the preparation or quality of food.

11. User Responsibilities

You agree not to:

  • Provide false information.

  • Misuse or abuse the platform.

  • Harass restaurants, delivery partners, or staff.

  • Place fake or fraudulent orders.

  • Attempt unauthorized access to the platform.

  • Upload harmful software or malicious code.

  • Violate any applicable laws while using SudurBite.

Violation of these Terms may result in suspension or permanent termination of your account.

12. Promotions and Coupons

Promotional offers, coupons, referral bonuses, and discounts:

  • May have expiry dates.

  • Cannot be exchanged for cash.

  • May be withdrawn or modified without notice.

  • Are subject to specific eligibility requirements.

SudurBite reserves the right to refuse promotions that are abused or fraudulently used.

13. Intellectual Property

All content on SudurBite, including but not limited to:

  • Logo

  • Brand name

  • Website design

  • Mobile application

  • Graphics

  • Text

  • Software

  • Icons

  • Images

is owned by or licensed to SudurBite and is protected under applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, or use any content without prior written permission.

14. Limitation of Liability

To the maximum extent permitted by law, SudurBite shall not be liable for:

  • Restaurant food quality issues

  • Allergic reactions

  • Delivery delays

  • Temporary service interruptions

  • Loss of profits

  • Indirect or consequential damages

  • Events beyond our reasonable control

Our liability, where applicable, shall be limited to the amount paid by the customer for the affected order.

15. Account Suspension or Termination

We reserve the right to suspend or permanently terminate any account that:

  • Violates these Terms.

  • Engages in fraudulent activity.

  • Misuses promotions or referral programs.

  • Harasses restaurants, delivery partners, or staff.

  • Violates applicable laws.

16. Privacy

Your use of SudurBite is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

17. Third-Party Services

SudurBite may integrate with third-party services including payment gateways, maps, analytics, and notification services. These services operate under their own terms and privacy policies.

18. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be published on our website with a revised Effective Date. Continued use of SudurBite after changes become effective constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Nepal.

Any disputes arising from these Terms or the use of SudurBite shall be subject to the jurisdiction of the competent courts of Nepal.
